2009 Town Election 

The following are on the ballot for key offices in the town of Arlington
and will appear in this order:

Board of Selectmen (3-year term)

Clarissa Rowe, 54 Brantwood (papers approved). www.clarissarowe.org/

John W. Hurd, 28 Colonial Drive (papers approved).

Assessor (3-year term)  

  Kevin P. Feeley, 25 Baker Road (papers approved).

 School Committee (3-year term)

Ballot Questions

This year, the ballot for town elections will have four questions for voters to answer.  The questions will appear on the ballot like this:

Question 1

Shall the Board of Selectmen be authorized to grant an additional 5 licenses for the sale of all alcoholic beverages to be drunk on the premises in restaurants and function rooms having a seating capacity of not less than 50 persons?

Summary of Question 1 (provided by the League of Women Voters)

At the request of the Board of Selectmen, the 2008 Annual Town Meeting voted to ask the Legislature to authorize placement of this question on the 2009 annual election ballot, which the Legislature did. This ballot question asks the electorate to authorize the Board of Selectmen to issue up to five additional licenses for the sale of all alcoholic beverages to be consumed on the premises in restaurants or function rooms that can seat at least 50 people.

Currently, the Board of Selectmen is authorized to issue up to ten licenses for the sale of alcoholic beverages to be consumed on the premises in restaurants or function rooms. To date, the Board of Selectmen has issued all ten of these licenses.  A “yes” vote on this ballot question would authorize, but not require, the Board of Selectmen to issue up to five additional licenses for the sale of alcoholic beverages to be consumed on the premises in restaurants or function rooms that can seat at least 50 people for a total of 15 such licenses.  A “no” vote would make no change in existing licensing of sales of alcoholic beverages for consumption on the premises.  This question does not affect package stores.

Do you favor allowing the service of alcoholic beverages without food in licensed restaurants?

Summary of Question 2

This is a nonbinding public opinion advisory question placed on the ballot be majority vote of the Board of Selectmen. Currently, the Board of Selectmen’s rules and regulations governing the sale of alcoholic beverages in restaurants require that any sale of alcohol be made in conjunction with the service of food. Through this ballot question, the Board of Selectmen seeks the input of the electorate on whether to modify this rule. The vote on this question will be advisory only and will not require the Board to change its rules.

Question 3 (nonbinding)

Do you favor increasing the number of stores in Arlington licensed to sell wine and malt beverages for consumption off-premises from three to five?

Summary of Question 3

This is a nonbinding public opinion advisory question placed on the ballot by majority vote of the Board of Selectmen. Currently, the Board of Selectmen, as the liquor licensing authority for the Town, is authorized to license up to three stores to sell wine and malt beverages for consumption off the premises. All three of these licenses have been issued. Through this ballot question, the Board of Selectmen seeks the input of the electorate on whether to pursue authorization for the issuance of two additional such licenses. The vote on this question will be advisory only and will not require the Board to take any action toward increasing the number of available off-premise licenses.

Question 4 (nonbinding)

Do you favor allowing stores in Arlington currently licensed to sell wine and malt beverages for consumption off-premises to sell all alcoholic beverages for consumption off-premises?

Summary of Question 4

This is a nonbinding public opinion advisory question placed on the ballot by majority vote of the Board of Selectmen. Currently, the Board of Selectmen, as the liquor licensing authority for the Town, is authorized to license up to three stores to sell wine and malt beverages for consumption off the premises. All three of these licenses have been issued. Through this ballot question, the Board of Selectmen seeks the input of the electorate on whether to pursue authorization to amend these licenses to allow the sale of all alcohol beverages. The vote on this question will be advisory only and will not require the Board to take any action toward changing the type of available off-premise licenses.

2009 Town Election Calendar, Rules

The Town Clerk shall not furnish blank forms for nomination of candidates for town office to any person other than a candidate seeking such nomination or a person presenting the signed authorization of a candidate to secure said forms on his behalf (Ch. 53, §17, G.L.).

Each candidate shall file with the Town Clerk prior to obtaining blank nomination papers, a statement containing his name and address, and the office for which he intends to be a candidate (Ch. 53, §9A, G.L.).

No candidate for town office shall receive more blank nomination papers than will contain the number of signatures required to place his name in nomination, multiplied by five.

Every nomination paper shall be filed by a responsible person and must contain the written acceptance of the candidate (Ch. 53, §9, G.L.).

THURSDAY, FEB. 5, 5 p.m. - LAST DAY AND HOUR FOR OBTAINING BLANK NOMINATION PAPERS (48 weekday hours prior to the hour on which nomination papers are required to be submitted to the Registrars of Voters for certification, Ch. 53, §9A, G.L.).

MONDAY, FEB. 9**, 5 p.m. - LAST DAY AND HOUR FOR TOWN MEETING MEMBERS WHO ARE CANDIDATES  FOR RE-ELECTION to give written notice thereof to Town Clerk (21 days prior to last day and hour for filing nomination papers with Town Clerk, Ch. 43A, §6, - Ch. 53, §10, G.L. as amended by Ch. 477, §18, Acts of 1985, if the last day is a Sunday or holiday, deadline is following day).**

MONDAY, FEB. 16, 5 p.m. - LAST DAY AND HOUR FOR SUBMITTING ALL NOMINATION PAPERS TO THE REGISTRARS OF VOTERS FOR CERTIFICATION OF SIGNATURES (14th day preceding on which they are to be filed with Town Clerk, Ch. 53, §'7, G.L., if the last day is a Sunday or holiday, deadline is following day).

MONDAY, MARCH 2**, 5 p.m. - LAST DAY AND HOUR FOR FILING NOMINATION PAPERS WITH TOWN CLERK (35th day preceding the date of election, Ch. 53, ?10, Ch. 50, ?4, G.L., if the last day is a Sunday or holiday, deadline is following day). **

NOTE: Nomination papers must have been filed at least 14 days previously with Registrars of Voters for certification of signatures.

WEDNESDAY, MARCH 4, 5 p.m. - LAST DAY AND HOUR FOR FILING WITHDRAWALS OF AND/OR OBJECTIONS TO ALL NOMINATION PAPERS with Town Clerk (within two (2) working days of last day fixed for filing such nomination papers, Ch. 53, ?11 & 13, Ch. 55B, ?7, G.L.).

THURSDAY, MARCH 5, 5:30 p.m. - DRAWING OF NAMES FOR POSITION ON BALLOT FOR ANNUAL TOWN ELECTION (Ch. 31, Acts 1972).

MONDAY, MARCH 16, 8 p.m. - LAST DAY TO REGISTER VOTERS FOR TOWN ELECTION (20th day preceding Annual Town Election (Annual Town Election is first Article of Annual Town Meeting) -- preceding day if final day falls on Sunday or holiday**, Ch. 51, ?26 & 31, G.L.).

SATURDAY, APRIL 4, 7 a.m. to 8 p.m. - ANNUAL TOWN ELECTION (First Article of Annual Town Meeting -- all other business considered at Town Meeting held on 4th Monday in April,  Art. 1, ?1 & 3, Town By-Laws, and ?1 of Town Manager Act).

MONDAY, APRIL 27 - ANNUAL TOWN MEETING BEGINS.

NUMBER OF SIGNATURES TO BE CERTIFIED

TOWN OFFICES --  except town meeting members -- nomination papers must be properly signed by at least 50 voters (1% of the entire vote cast for governor at preceding State Election -- maximum number required 50).  Registrars need not certify a greater number of names than are required to make a nomination, increased by two-fifths thereof -- or 70 (Ch. 53, ?6 & 7, G.L., No more than 8 blank nomination papers issued).

TOWN MEETING --  properly signed by not less than 10 voters of the precinct in which the candidate resides (no more than 1 blank nomination paper issued).

Public Offices may be closed on Saturdays; if Saturday is last day of time period it has same effect as legal holiday.  (Accepted by Annual Town Meeting - May 20, 1947)
