Judge denies rights injunction targeting Marzilli; appeal expected |

A judge has denied a request for a rarely used civil rights injunction against state Sen. J. James Marzilli Jr. seeking to bar him from harassing all women in Massachusetts, various media outlets reported Aug. 19. Attorney Wendy Murphy had sought the civil rights protection after three women she represents claimed the Arlington Democrat accosted them. Murphy reportedly plans to appeal. A civil rights violation would have carried a penalty of as long as 10 years in prison.

Marzilli has pleaded not guilty in criminal court to charges of sexually harassing four women in Lowell In June.
Middlesex District Attorney Gerard Leone had said there was not enough evidence to prosecute a case involving one of the women represented by Murphy.
Middlesex Superior Court Judge Sandra Hamlin denied the preliminary injunction request Aug. 15, according to accounts reported by the Associated Press and Channel 5.
Wickedlocal reported Aug. 20 that the judge's ruling opens the door for an appeal in state court.
Judge Hamlin ruling said the plaintiff's attorney had not proved the senator intended to harass women in the future, the report said.
Murphy has 30 days from the decision to file an appeal.
