James Marzilli Jr., Democrat of Arlington, pleaded not guilty July 9 to charges he
accosted four women in Lowell on June 3. The Boston Herald reported that Marzilli, who has been undergoing treatment at McLean Hospital for a bipolar disorder, was ordered to stay of out Lowell. The Boston Globe reported the story by focusing on confirmation of the diagnosis of bipolar disorder. YourArlington reported that June 21.

The Globe quoted Wendy Murphy, a lawyer representing an Arlington woman who told
authorities she was groped by Marzilli in a separate case, saying any
medical condition is no excuse for the alleged criminal actions.
The Herald reported that prosecutors have building surveillance video
of Marzilli on Middle Street, where one of the attacks is alleged to
have occurred. They declined to comment on what the video shows
Marzilli doing.
There also exists a DVD of photos of Marzilli’s car
parked on Hurd Street in Lowell, also on the day of the alleged
assaults, the Herald said.
Court papers released July 9 also state one of the alleged victims was a 60-year-old grandmother who walked with a cane and was so unnerved by Marzilli’s alleged advances, she fell down after boarding a bus, the Herald reported.
Marzilli remains free on $1,500 cash bail and is to return to court July 28 for a pretrial conference. He and his wife, Susan Shaer, 64, left today’s brief proceeding holding hands and ignoring reporters and news cameras and sped off in a white Toyota Prius.
Marzilli’s attorney, Terrence W. Kennedy of Everett, said the senator “feels prepared” to fight the charges., the Herald said.
Middlesex District Attorney Gerry Leone said a Middlesex
grand jury indicted Marzilli, 50, July 1 on charges stemming from his
encounters with these women.
The Globe account has more information than does the Herald story about the views of Marzilli's lawyer. The Globe reports:
"Kennedy vowed to fight the accusations, questioning their factual and constitutional basis.
"He
told reporters before the arraignment that he has been told that one of
the victims who initially accused the Arlington Democrat of groping her
did not support the allegation during grand jury testimony.
"He said he expects to file a motion asking the judge to dismiss the most serious charge, indecent assault and battery.
"Kennedy
said he also expects to challenge the constitutionality of the charges
of annoying and accosting people of the opposite sex on the basis that
they would not apply to people of the same sex who might engage in the
identical offense.
"'There will be a number of motions to dismiss that I anticipate will be successful,' Kennedy told reporters after the hearing."
Marzilli has been free on $1,500 cash bail since pleading not guilty at an arraignment in Lowell District Court on June 4.
